The role of the Dean Park Estates Community Association in
“enforcing” the Schedule of Restrictions is:
1. To “approve/not approve” requests for exterior additions or
changes to buildings to ensure compliance with the Schedule
of Restrictions;
2. To provide an interpretation when there is disagreement
between property owners regarding a breach of the Schedule
of Restrictions;
3. Based on past legal opinions and individual experiences with
previous situations, to provide advice to members of the
Association on ways to resolve the issue; and
4. To provide documentation to support a member’s position
in the event of a legal action. Note: A “covenant” is only
enforceable between property owners. The Association
cannot unilaterally take legal action against a property
owner for a breach of the Schedule of Restrictions.
